PRELIMINARY ARTICLE – PREAMBLE

This privacy policy is addressed to users (hereinafter “the User”) of the website https://hespris-properties.com (hereinafter “the Site”) published by the company Agence du Moulin, a simplified joint-stock company (SAS) registered with the Grasse Trade and Companies Register under number 910 137 595, and aims to present to the User the nature of the personal data processing carried out on the Site.

Hesperis Properties is committed in any case to respecting the following essential principles:

  • Collect only the data strictly necessary for their purpose.

  • The User remains the owner of their personal data.

  • The data is processed transparently, confidentially, and securely.

  • The data is retained only for a period not exceeding that necessary for the purposes for which it is processed.

The processing of personal data is governed by:

  • Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms.

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, effective May 25, 2018 (hereinafter “GDPR”).

In accordance with the latest CNIL recommendations on cookie collection, Hesperis Properties takes all necessary measures to ensure that the User is fully aware of the extent of their rights and can exercise them.

ARTICLE 1 – PURPOSES OF PROCESSING

The data may be collected for explicit, legitimate, and determined purposes to ensure:

  • The proper functioning and continuous improvement of the Site, its services, and its functionalities.

ARTICLE 2 – DATA CONTROLLER

Personal data is collected and processed by Hesperis Properties, a limited liability company whose registered office is located at 123 Rue de l’Exemple, 75001 Paris, registered with the Paris Trade and Companies Register under number 123 456 789, which is the data controller of personal data processed in the context of the operation of the Site and the training platform.

ARTICLE 3 – COLLECTION AND PROCESSING OF PERSONAL DATA

The personal data provided by the User to Hesperis Propertiesr is subject to computer processing and is stored and used by Hesperis Properties for the purposes described in the aforementioned article and concerns:

  • Recording and management of orders and the provision of corresponding products and/or services.

Hesperis Properties may send commercial solicitations to Users who have accepted it. ARTICLE 5 – RECIPIENTS OF PERSONAL DATA

Only the authorized and determined persons mentioned below may have access to the User’s data:

Authorized personnel of the various services of Hesperis Properties (authorized personnel of the communication, administrative, logistics, and IT services, customer relations officers, and control officers).

Hesperis Properties subcontractors who act on behalf and under the instructions of the Company, including the Site host.

The secure payment service (information available on the payment provider’s site).

The relevant courts, mediators, accountants, auditors, lawyers, bailiffs, debt collection companies.

Third parties who may deposit cookies on the User’s devices (computers, tablets, mobile phones) when they consent.

ARTICLE 6 – DATA RETENTION PERIOD

Hesperis Properties undertakes to ensure that the data collected is stored in a form that allows the User to be identified for a period not exceeding the period necessary for the purposes for which these data are collected and processed. However, these data may be retained to comply with a legal obligation or kept in files in accordance with applicable regulations and laws.

By exception, the User’s identification data is kept by Hesperis Propertiesfor a period of three (3) years from the last contact with the User. For the management of the business relationship with the User and customer follow-up, the data is kept for three (3) years from the end of the business relationship if the User is a customer. For the management of requests for rights over the User’s data, the data is kept for one (1) year.

In any case, personal data will not be kept beyond the maximum retention period provided by the Regulations and Laws in force and in accordance with the needs of Hesperis Properties’s activity, which is:

36 months from the last connection for identification data.

36 months from the date of the order for order-related data.

A maximum of 13 months from their provision for banking data.

12 months from the last activity on the Site for prospect data.

Once these periods are reached, some of the Personal Data in question may be subject to an archiving procedure for accounting management and litigation management or requisitions, for a period not exceeding the legal requirements in these matters.
